Terms of Service

Castly Portal LLC Effective Date: May 3, 2026

1. Introduction

These Terms of Service ("Terms") are a legally binding agreement between you and Castly Portal LLC ("Castly," "we," or "us"), governing your use of the Castly mobile application. By using the app, you confirm you have read and agree to these Terms and our Privacy Policy.

Castly Portal LLC operates under the laws of the United Arab Emirates.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under UAE law. By using Castly, you confirm you meet these requirements. We reserve the right to suspend or terminate any account where eligibility requirements are not met.

3. Account Registration

You agree to provide accurate information when registering, keep your credentials confidential, and accept responsibility for all activity under your account. Castly reserves the right to refuse or cancel accounts at its discretion.

4. Acceptable Use

You agree to use Castly lawfully and for its intended purpose only. You must not:

• Impersonate others or misrepresent your identity

• Upload offensive, harmful, or unlawful content

• Attempt to hack, scrape, or disrupt the Platform

• Reverse engineer any part of the app

• Violate any applicable UAE law or regulation

5. User Content

You retain ownership of content you upload (photos, personal details, etc.). By uploading, you grant Castly a limited licence to store and process your content solely to deliver the Platform's services. You are responsible for ensuring your content does not infringe third-party rights. We reserve the right to remove content that violates these Terms.

6. Payments

All payments are processed exclusively by Mamopay, a UAE Central Bank-regulated financial institution. Castly does not store or access your IBAN or payment credentials. By making a payment, you also agree to Mamopay's terms. Refund requests are assessed case-by-case in line with UAE consumer protection law.

7. Intellectual Property

All content, trademarks, and software on the Platform belong to Castly Portal LLC. You are granted a limited, personal, non-commercial licence to use the app. You may not reproduce, modify, or distribute any part of the Platform without our written consent.

8. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the fullest extent permitted by UAE law, Castly shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid to Castly in the 12 months preceding any claim.

9. Termination

You may delete your account at any time. We reserve the right to suspend or terminate your access at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. Sections 7, 8, and 10 survive termination.

10. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the competent UAE courts. We encourage you to contact us first to resolve concerns informally.

11. Changes to These Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
